Chapter 1 Military service

Article 1

  1. The military is to perform a physical and psychological screening before employing any new personnel member.
  2. All military personnel are attributed all fundamental rights as per the Constitution.
    1. except where lawful military necessity applies.

Article 2

  1. Personnel must follow any lawful order, no exceptions.
  2. Unlawful orders are defined as the following:
    1. Unconstitutional orders
    2. Orders that violate the Wartime Conduct Act
    3. Orders belayed by the Admiralty or the Supreme Court
    4. Orders that violate criminal law or civil rights.

Article 3

  1. Civilians reserve the right to enroll into any military academy.
    1. Civilians must complete screenings as per Article 1.2
    2. Civilians must complete basic training after graduation to be employed by the military
  2. Military academies can be attended without cost in the following cases:
    1. The attendee is already military personnel.
    2. The attendee pledges to serve in the military for at least 10 years after graduation.
    3. Applies to all attendees.

Chapter 2: Emergency Protocols

Protocol 12

Invoke Martial Law in (a part of) Terran Commonwealth territory. Protocol 12 is ordered by the Admiralty on direction of the Supreme Court and DoD. This may only be invoked in times of war.

Subsection 1

  1. Time limits of martial law periods are between 4 weeks and 3 months, afterwards the military must apply for renewal with the Supreme Court.
  2. Renewal can only be approved if civil unrest or active warfare an be proven.

Subsection 2

  1. Martial law authorises the military to perform the following actions:
    1. Put a curfew in place and enforcing this curfew.
    2. temporarily suspend elections in the affected area.
    3. Investigate any government personnel for espionage.

Protocol 45

Start invasion of a planet in a early age of development. Can only be ordered by the Commanding Officer overseeing the monitoring of the planet in question. Use of this protocol is only authorised if:

  • The population of the planet is threatened by immediate extinction.
  • If planetary evacuation is needed to preserve the species
  • adversary exerts a claim and presents an imminent threat of occupation or extermination.
    • Can be unauthorised to prevent war.

Use of protocol 45 must be approved by both DoD and admiralty officials.

Protocol 66

Remove a sitting executive by any means necessary. This protocol can only be activated by any Admiralty member as a final fail safe. Cases of authorised use are the following:

  • Continuous unconstitutional actions by an Executive.
  • An Executive has been impeached and refuses to leave office.
  • By proven corruption of a government official, with approval of the Supreme Court.

Any other reasons are unlawful and thus treason as per the Constitution.

Subsection 1

  • Any use of this protocol must be with unanimous approval of both the Admiralty board and the Supreme Court.
  • Lethal force can only be authorised if:
    • Military operatives are in lethal danger during arrest.
    • Target official endangers civilian life directly

Subsection 2

  • The Senate reserves the right to invoke an inquiry with the Admiralty after protocol 66 is issued.
